These Terms & Conditions apply to the use of hemakshivalera.com and purchases made through the website. They operate together with product information shown on the website, the Refund & Returns Policy, Privacy Statement and Shipping & Delivery information. Nothing in these terms excludes rights that cannot legally be excluded.
About the store
The website offers original artwork by Hemakshi Valera, framed fine art prints, handmade or small-format art products, made-to-order art accessories, commission services and occasional promotional or digital freebies.
Orders and availability
Original artworks are one of one unless stated otherwise. Adding an item to a cart does not reserve it. An order is accepted when payment is successfully authorised and the order can be fulfilled. If an item becomes unavailable because of an inventory or technical error, I will contact you and arrange a refund or suitable alternative.
Prices and payment
Prices are shown in Australian dollars (AUD) unless stated otherwise. Applicable shipping and other charges are shown at checkout or on the relevant product/order information. Payment must be authorised before fulfilment begins.
Artwork photographs and handmade character
I make reasonable efforts to photograph artwork accurately, but screen settings, lighting and devices can affect colour and perceived scale. Texture, hand-painted marks and natural variation are part of original and handmade artwork and are not defects.
Made-to-order products and fulfilment partners
Selected framed prints and art accessories may be produced by a third-party production partner such as Printful after an order is placed. Production location, packaging, processing time and carrier may vary. Products from different fulfilment locations can arrive separately.
Shipping and delivery
Current delivery information is set out on the Shipping & Delivery page. Shipping prices shown at checkout are part of the order total. Delivery timeframes are estimates unless expressly stated otherwise.
Commissions
Commission projects may have additional written terms covering dimensions, creative direction, price, deposit, milestones, approvals, delivery, revisions and cancellation. Those agreed project-specific terms form part of the contract for that commission.
Copyright and intellectual property
Buying a physical artwork or product does not transfer copyright, reproduction rights or commercial licensing rights unless expressly agreed in writing. Artwork, photographs, designs, wallpapers and website content remain protected by copyright. You may enjoy and display purchased physical artwork for normal personal use, but you may not reproduce, manufacture from, sell copies of, license or commercially exploit the artwork without written permission.
Free wallpapers and digital content
Free Sounds of Silence wallpapers are provided for personal, non-commercial use on your own devices. They may not be resold, redistributed as files, uploaded as stock or digital products, printed for sale, used in merchandise or used commercially without written permission.
Newsletter and marketing
Marketing emails are optional. Purchasing from the store does not require newsletter subscription. If you choose to subscribe, you can unsubscribe using the link included in marketing emails.
Returns and refunds
Please read the Refund & Returns Policy. Consumer guarantees and other mandatory legal rights apply where relevant.
Website use
You must not misuse the website, interfere with its security or operation, attempt unauthorised access, or reproduce substantial website content for commercial use without permission.
Liability
Nothing in these terms excludes or limits liability that cannot legally be excluded or limited. To the extent permitted by law, I am not responsible for indirect loss that was not reasonably foreseeable or for delays caused by events outside reasonable control.
Governing law
These terms are governed by the laws applicable in Victoria, Australia, subject to any mandatory consumer protections that apply to a customer.
